1. Scope and Operator
These Terms and Conditions govern the use of the Planetary Intelligence platform ("Platform"), operated by JaWelt Bay GmbH, Kaiserstr. 5, 40479 Düsseldorf, Germany ("JaWelt Bay GmbH", "we", "us", or "our") under the AstraSense brand.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Description of Service
Planetary Intelligence is a satellite change-detection and analysis platform that processes publicly available and licensed satellite and planetary datasets to deliver explainable change-detection outputs for Earth and Mars.
The Platform is intended for research, scientific, and professional use. Results are indicative and depend on data availability, resolution, and temporal coverage. They do not constitute certified scientific findings or operational decisions.
3. Access and Registration
Access to the Platform is by invitation or approved request only. To request access, contact us at info@ja-welt.com.
You are responsible for maintaining the confidentiality of any credentials provided to you and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Permitted Use
You may use the Platform solely for lawful purposes and in accordance with these Terms. You agree not to:
• Use the Platform in any way that violates applicable local, national, or international law or regulation.
• Attempt to gain unauthorised access to any part of the Platform or its related systems.
• Reproduce, distribute, or create derivative works from Platform outputs without prior written consent.
• Use the Platform to process data for military targeting, surveillance of individuals, or any purpose that violates human rights.
5. Intellectual Property
All intellectual property rights in the Platform, including its software, algorithms, visual design, and documentation, are owned by JaWelt Bay GmbH or its licensors.
Satellite and planetary datasets used by the Platform are sourced from publicly available repositories (e.g. NASA missions including MODIS, THEMIS, MOLA) and are subject to their respective licences. JaWelt Bay GmbH makes no claim of ownership over such source data.
6. Data and Privacy
We process personal data in accordance with our Privacy Policy and applicable data protection law, including the General Data Protection Regulation (GDPR).
By using the Platform, you acknowledge that we may process data you provide (e.g. contact information, usage data) for the purposes of operating and improving the service. For questions about data processing, contact info@ja-welt.com.
7. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. JaWelt Bay GmbH does not warrant that:
• The Platform will be uninterrupted, error-free, or free of harmful components.
• Results produced by the Platform are accurate, complete, or suitable for any particular purpose.
You use the Platform at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, JaWelt Bay GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.
Our total liability to you for any claim arising under these Terms shall not exceed the amount paid by you (if any) for access to the Platform in the twelve months preceding the claim.
9. Changes to the Platform and Terms
We reserve the right to modify or discontinue the Platform (or any part of it) at any time without notice. We may also update these Terms from time to time. Material changes will be communicated via the Platform or by email.
Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Düsseldorf, Germany, to the extent permitted by law.
